By accessing or placing an order through this website, you agree to be bound by these Terms and Conditions.


2. ELIGIBILITY

You must be at least 18 years old to place an order.

By placing an order, you confirm that:

  • You are legally capable of entering into a binding contract

  • All information provided is accurate and complete


3. PRODUCTS

All cakes are handmade and made to order.

Due to the bespoke and handcrafted nature of our products:

  • Designs, colours and decorative finishes may vary slightly

  • Sizes and serving portions are estimates only

  • Exact colour matches cannot be guaranteed

Product images are for illustrative purposes only.


4. PRICES AND PAYMENT

All prices are in GBP (£).

We reserve the right to amend prices before order confirmation.

Full payment is required before production begins.

Payments are processed securely via third-party payment providers using industry-standard security measures. We do not store full card details.


5. PERSONAL DATA

We process personal data in accordance with our Privacy Policy and in compliance with:

  • UK GDPR

  • Data Protection Act 2018

You have the right to:

  • Access your personal data

  • Request correction

  • Request deletion

  • Restrict processing

  • Lodge a complaint with the Information Commissioner’s Office

6. CANCELLATIONS

As our cakes are personalised and made to order, they are exempt from the 14-day cancellation right under the Consumer Contracts Regulations 2013.

Cancellations:

  • More than 7 days before delivery: may receive a credit note, subject to a 30% administration deduction

  • Within 7 days of delivery: non-refundable

  • Within 72 hours of delivery: cannot be cancelled

Discounted or promotional orders are non-refundable.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.


7. DELIVERY

We deliver within the local East Didsbury area.

Delivery dates are estimates only.

While we take reasonable care to deliver on the agreed date, we are not liable for delays caused by circumstances beyond our reasonable control.

Risk passes to you upon delivery or collection.

If delivery fails due to incorrect details or absence, additional delivery charges may apply.

If we are unable to fulfil delivery, a full refund will be offered.


8. COLLECTION

The person collecting the cake is responsible for checking:

  • Condition

  • Design

  • Spelling

  • Colour

Once the cake leaves our premises, responsibility transfers to the customer.


9. ALLERGEN INFORMATION

Our bakery handles:

Milk, Dairy, Gluten (Wheat, Barley, Oats), Soya, Peanuts, Tree Nuts, Lupin, Sesame, Celery, Sulphur Dioxide and other allergens.

We cannot guarantee that our products are free from cross-contamination.

Full allergen information is available upon request.

It is the customer’s responsibility to inform us in writing of any allergies at the time of ordering.


10. QUALITY AND CONSUMER RIGHTS

If a product is not:

  • Of satisfactory quality

  • As described

  • Fit for purpose

You may be entitled to remedies under the Consumer Rights Act 2015.

We must be notified:

  • Immediately upon collection, or

  • Within 24 hours of delivery

We may require the return of the product (or part of it) for inspection.

Our maximum liability is limited to the purchase price of the cake and delivery fee.

Nothing in these Terms excludes liability for death or personal injury caused by negligence or for fraud.


11. WEBSITE USE

You must not:

  • Use the website unlawfully

  • Introduce malware

  • Attempt unauthorised access

  • Misuse personal data

We reserve the right to suspend access for breach of these Terms.


12. INTELLECTUAL PROPERTY

All website content, images, cake designs, branding and materials remain the intellectual property of Josephine’s Homemade Cakes and may not be reproduced without written consent.


13. FORCE MAJEURE

We are not liable for failure or delay caused by events beyond our reasonable control.


14. SEVERABILITY

If any provision of these Terms is found unenforceable, the remainder shall remain valid.


15. GOVERNING LAW

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
